You remember that post about the homestuck t-shirt design contest collaborating with hot topic? And how Hot Topic are the biggest art thieves?  This is recent.  As you can see above, I stumbled upon Hot Topic’s website and they are selling a very popular fan art put on a t-shirt, and did not ask permission from the original artist (rismo).

This shows Hot Topic still continues their art thievery.  Hot Topic are still taking art from artists without their permission.  This is disrespectful and appalling.

EXCEPT YOU DID GIVE THEM YOUR PERMISSION.

BY AGREEING TO TERMS AND CONDITIONS ON DEVIANT ART.

THEY SOLD IT TO A THIRD PARTY ROYALTY-FREE.

yo okay this is REALLY FUCKING IMPORTANT and imma be deleting my DA very soon because of it.

Do we have a copyright person in the house? I’m pretty sure that this isn’t correct and that that wording is necessary for DA to be able to display anything at all. (Legalese sure is weird!)

Most of it is as you say, however there are subsections 3 d and e which look questionable, however part 5 explicitly indicates that DA will get permission from thee artist before making a third party deal, which the Hot Topic thing would come under. So no, the artist did NOT give Hot Topic the right to use their art through this agreement.

So dA remains shifty but not necessarily at fault, the artist certainly isn’t at fault, and Hot Topic is definitely a thieving piece of shit.

Folks, please stop spreading panicky bullshit like this around before you find an informed opinion on it first! If you aren’t familiar with legalese you’re pretty likely to misinterpret it, especially if you fly off the handle at the first questionable thing you come across (like a bunch of people in this reblog chain did).

Okay, I’m not a lawyer or anything, but:

Giving a license to deviantArt to display your art royalty-free does not, in and of itself, give them a license to sell it to other people. Or for other people to use it royalty-free. Basically everyone (including tumblr) will have some kind of thing saying you’re giving them license to display your work, or else they can’t host it for you.

Maybe there’s stuff somewhere else in their agreement that allows them to license it to Hot Topic or something, but unless Hot Topic actually is deviantArt, a license granted to deviantArt does not give Hot Topic anything.

Seriously, I can’t even understand how anyone could think that the quoted text gives an unrelated third party rights to use the work.

Oh wow. This is the first time I’m hear about Hot Topic doing this kind of bullshit. =/

But yeah— I’m pretty sure everyone’s going to rain HELL on DeviantArt if it turns out they can do something as under-the-table as giving Hot Topic permission to snag peoples deviations and sell them on shirts. But It doesn’t look like that’s the case hopefully (according to the above poster & the actual TOS).

It really needs to be clarified for the mass majority to understand what powers the third-party companies would have. 

Edit: I re-read the page again to see if they were more specific about what a 3rd party can and can’t do AND…

12. No Liability for Third Party Use. Which basically means: “Hey, we just host the images. If anyone associated or associated with us stole this image to be an asshole, we didn’t tell them it was allowed or acceptable.”

So, Yeah. Hopefully every learns not to have knee-jerk responses to things like this anymore. 

The only ones who should be attacked in this case is Hot Topic themselves.

This Teacher Asked Her Students to Write to an Author. Kurt Vonnegut Wrote Back This

In 2006 Ms. Lockwood, an English teacher at Xavier High School, asked her students to write a letter to a famous author. She wanted them discuss the author’s work and ask for advice. Kurt Vonnegut (1922 – 2007) was the only one to write back and his advice is worth reading. 

Dear Xavier High School, and Ms. Lockwood, and Messrs Perin, McFeely, Batten, Maurer and Congiusta:

I thank you for your friendly letters. You sure know how to cheer up a really old geezer (84) in his sunset years. I don’t make public appearances any more because I now resemble nothing so much as an iguana.

What I had to say to you, moreover, would not take long, to wit: Practice any art, music, singing, dancing, acting, drawing, painting, sculpting, poetry, fiction, essays, reportage, no matter how well or badly, not to get money and fame, but to experience becoming, to find out what’s inside you, to make your soul grow.

Seriously! I mean starting right now, do art and do it for the rest of your lives. Draw a funny or nice picture of Ms. Lockwood, and give it to her. Dance home after school, and sing in the shower and on and on. Make a face in your mashed potatoes. Pretend you’re Count Dracula.

Here’s an assignment for tonight, and I hope Ms. Lockwood will flunk you if you don’t do it: Write a six line poem, about anything, but rhymed. No fair tennis without a net. Make it as good as you possibly can. But don’t tell anybody what you’re doing. Don’t show it or recite it to anybody, not even your girlfriend or parents or whatever, or Ms. Lockwood. OK?

Tear it up into teeny-weeny pieces, and discard them into widely separated trash recepticals. You will find that you have already been gloriously rewarded for your poem. You have experienced becoming, learned a lot more about what’s inside you, and you have made your soul grow.
